Terms of Service

1. Acceptance of Terms

These Terms are an agreement between you and Portagr, which operates Portagr (“the Service”). By accessing or using the Service, or by ticking the box at sign-up, you agree to be bound by them. If you do not agree, please do not use the Service.

2. Description of Service

Portagr is an interactive trip-planning tool for the Boundary Waters Canoe Area Wilderness (BWCA). It provides route suggestions, portage information, and campsite locations to assist with recreational trip planning. The Service is intended solely as a planning aid and is not designed or intended to be used as a real-time navigation device.

4. Accuracy of Information

We make reasonable efforts to maintain accurate portage and campsite data, but we make no warranty, express or implied, regarding the completeness, accuracy, reliability, or fitness for any particular purpose of the information provided. Route calculations are algorithmic estimates and may not reflect actual on-the-ground conditions.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Portagr and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to injury, death, property loss, or financial loss — arising out of or related to your use of, or inability to use, the Service or any information obtained through it.

6. Intellectual Property

The Portagr application, its interface, our routing algorithms, our written route and lake descriptions, and our guides are owned by Portagr.

Much of the underlying geographic data is not ours, and we make no claim over it:

• OpenStreetMap — map tiles and derived water data, © OpenStreetMap contributors, licensed under the Open Database License (ODbL). Anything we derive from it stays under that license, including its share-alike terms.
• U.S. Forest Service (Superior National Forest) — portage, campsite and entry-point data. As a work of the United States government it carries no copyright under 17 U.S.C. §105 and is free for you to use.
• U.S. Geological Survey — elevation and hydrography data, public domain.
• Esri — satellite imagery in the aerial basemap, © Esri and its imagery partners, used under their terms.

7. Permitted Use

You may use the Service for trip planning, subject to the plan you subscribe to. You agree not to:

• Scrape, bulk-copy, or redistribute our original content — route and lake descriptions, guides, our routing algorithms, and our compiled ratings. This does not restrict the third-party datasets in Section 6, which you are free to obtain and use under their own licenses, direct from their sources.
• Use automated tools in a way that places an unreasonable load on the Service
• Use the Service in any way that could harm, disable, or impair it
• Attempt to gain unauthorized access to any part of the Service

8. Your Content

You can submit reviews, ratings, notes and photographs (“Your Content”). Your Content stays yours — we claim no ownership of it.

The permission you give us. By submitting Your Content you grant Portagr a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and distribute it for the purpose of operating and promoting the Service, together with the right to resize, crop or re-encode it for display. The license lasts as long as you leave the content up. Delete a review or your account and the license ends, except for copies already made for backup, which age out on our normal backup schedule.

What you promise.That you took the photograph or otherwise have the right to submit it, that submitting it does not infringe anyone’s rights, and that what you describe reflects an actual visit.

You agree not to submit content that:

• Infringes copyright, trademark, privacy or any other right
• Is unlawful, defamatory, harassing, hateful, or sexually explicit
• Identifies another person without their permission, or reveals someone’s private information
• Is a fake or paid review, or a review of a place you have not been
• Advertises a business or service, unless we have agreed to it in writing
• Contains malware, or automated or bulk submissions

We may remove or refuse any content, and suspend or close an account, at our discretion — in particular content reported to us as violating these rules. We do not pre-screen submissions, and we are not obliged to monitor them. Reports can be sent through our contact form.

9. Copyright Complaints (DMCA)

If you believe content on Portagr infringes your copyright, send a notice under the Digital Millennium Copyright Act to the address below:

Your notice must include:

• Your physical or electronic signature
• Identification of the copyrighted work you say has been infringed
• The URL of the material on Portagr you want removed
• Your address, telephone number and email address
• A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf

We remove material that is the subject of a valid notice and notify whoever posted it, who may send a counter-notice. We terminate the accounts of repeat infringers. Filing a knowingly false notice can make you liable for damages under 17 U.S.C. §512(f).

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The effective date at the top of this page will reflect the date of the most recent revision.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions.

12. Subscriptions, Billing & Refunds

Portagr offers paid subscription plans (Portagr Pro). The price and billing interval (monthly or annual) are shown at checkout. Paid plans auto-renew each period until you cancel.

• Payments are processed by Stripe via Clerk Billing. We do not receive or store your full card details.
• Portagr Pro includes a 7-day free trial that automatically converts to a paid subscription unless you cancel before it ends.
• You can cancel any time from your account settings; access continues to the end of the current billing period.
• Once charged, payments are non-refundable and we do not prorate partial billing periods. Full details are in our Refunds & Cancellations policy.
• Cancelling is as easy as subscribing — one control in your account settings, no phone call and no retention interview.

We disclose the renewal terms again next to the subscribe button, and ask you to consent to automatic renewal separately there, as required by the FTC’s negative-option rule, California’s Automatic Renewal Law and Minn. Stat. §325G.30. After you subscribe we send an acknowledgment by email recording what you signed up for and how to cancel.

14. Accessibility

The Boundary Waters should be plannable by anyone who wants to go. We aim to meet WCAG 2.2 Level AA across the site, and we treat accessibility defects as bugs rather than as enhancements.

One gap we will not paper over: the interactive map is drawn on a canvas and cannot be read by a screen reader or operated by keyboard. Route pages carry a written leg-by-leg breakdown of the same information, and lake, portage and campsite pages describe what the map shows in prose. Sign-in, checkout and ad units are rendered by Clerk, Stripe and Google, whose markup we do not control.

If something on Portagr is hard or impossible to use, please tell us — it is the fastest way for us to find and fix it. Email portagradmin@gmail.com or use our contact form, telling us the page, what you were trying to do, and what you browse with if you know it. We aim to acknowledge within 5 business days and to give you a fix or a timeline within 30 days. If you need information from a page you cannot use, ask and we will send it to you another way.
